THE NATIONAL COURT REJECTS DISCRIMINATION AGAINST NON-EU CITIZENS WHO RENT PROPERTIES IN SPAIN, ALLOWING THEM TO DEDUCT EXPENSES

The ruling handed down on 28 July 2025 by the hashtag#NationalCourt, Contentious Chamber, appeal no. 636/2021, prohibits discrimination by the Treasury against non-EU foreigners who hashtag#rent property in Spain. It also considers that it is contrary to EU law and Article 63 TFEU (free movement of capital) to limit the possibility of hashtag#deducting the expenses necessary to obtain income from the hashtag#rental of property to EU or EEA residents, without accepting that it also applies to the tax returns of hashtag#NonResidents from third countries.
